The share4earth platform provides Carpooling Services, connecting individuals for shared private vehicle rides along similar routes and times to reduce traffic congestion and promote sustainability. Users can offer or find carpool/bikepool options such as Carpool Givers or Carpool Takers, matched based on their preferences.

Definitions:

• Account: is the user account that needs to be created by each user of share4earth platform for registration and usage.

• Member: Users registered for Carpooling Services.

• Carpool Giver: Offers empty seats in their private vehicle for shared rides. The intention is purely to reduce traffic congestion and fight pollution, with no intention of earning money or other benefits through this service.

• Ride Vehicle: Carpool Giver's vehicle for sharing rides. This shall be a private vehicle registered under the name of an individual. Any vehicle registered as a commercial vehicle shall not be eligible to be a part of share4earth carpooling services

• Carpool Taker: Seeks shared rides to reduce congestion and pollution, willing to share costs.

Carpooling Service Description & Disclaimers:

• The platform facilitates connections between Carpool Givers and Takers by matching the relevant individuals.

• The act of carpool giver giving a ride and the carpool taker asking for a ride is purely voluntary. Both these parties may choose to accept or decline the match at their discretion

• Ride sharing may or may not be accompanied by ride cost sharing, which will be mutually agreed upon between carpool giver and carpool taker before the ride starts.

• Share4earth platform is not a transport carrier and does not provide transportation services

Carpool Giver and Taker Responsibilities:

• Carpool Giver: Ensures:

  • Valid license and vehicle ownership.

  • Vehicle condition and valid insurance coverage.

  • Compliance with laws and regulations.

  • Non-discrimination and harassment policies.

  • Agreement to terms and conditions.

  • The carpool vehicle is a private vehicle and not a commercial vehicle.

  • The carpool vehicle is not registered with any taxi, transport, or commercial service.

  • The carpooling trips shall not be for any unlawful activities.

  • In the event of any motor accident, carpool giver shall be solely liable to comply with any legal or statutory requirements of proceedings

• Carpool Taker: Agrees to:

  • Compliance with laws and regulations.

  • Timely arrival and payment of agreed costs.

  • Agreement to Good Conduct Charter.

 

This User Agreement ("Agreement" or "Terms of Service") describes the terms and conditions under which SG Enviro Social Services offers the user access to the share4earth platform.

1. Agreement Overview:

   1. This Agreement governs the use of the share4earth platform, an application owned and operated by SG Enviro Social Services, located at 55/2, Vijay Nagar, Talab Tillo, Shiv Temple, OH Road, Jammu, J&K - 180001. The terms "share4earth platform", ”share4earth” and "SG Enviro Social Services" are used interchangeably as the context requires. By signing up for or using the share4earth platform, you confirm your understanding and acceptance of this Agreement.

2. Amendments:

   1. SG Enviro Social Services reserves the right to amend this Agreement periodically. Updated terms will be posted on the share4earth platform. Your continued use of the platform after amendments constitutes acceptance of the revised terms.

3. Termination:

   1. SG Enviro Social Services may terminate or suspend access to the share4earth platform without prior notice or liability, including for breaches of these Terms.

   2. Users may terminate the agreement by closing their User Account. Share4earth platform reserves the right to retain user account data as required.

4. Limited License:

   1. Subject to compliance with these Terms, users are granted a limited, revocable, non-exclusive, non-transferable license to access the share4earth platform via the WhatsApp Application on a mobile device owned or controlled by the user.

   2. Users shall not sublicense, sell, modify, or reverse engineer the platform. Prohibited activities include sending spam, storing infringing material, or interfering with platform integrity.

5. Enforcement:

   1. SG Enviro Social Services reserves the right to investigate and prosecute violations of these Terms and may cooperate with law enforcement authorities.

   2. The platform may monitor user access and content for operational purposes, compliance, or to fulfill legal obligations.

6. Removal of Content:

   1. SG Enviro Social Services reserves the right to remove or disable access to any content or account deemed in violation of these Terms or harmful to the platform, without prior notice.

7. Eligibility:

   1. Our Services are available only to individuals who can form legally binding contracts under applicable law. By becoming a Participant, you represent and warrant that you are at least 18 years old and have the right, authority, and capacity to enter into and abide by this Agreement.

   2. You represent that you are the sole authorized user of your account and are responsible for maintaining its confidentiality. If you suspect any unauthorized access to your account, you must take immediate action and notify us.

8. Verification of IDs and Phone Number:

   1. By accepting these terms, you consent to share4earth platform collecting and using your profile information and IDs/documents for verification purposes through third-party service providers.

9. Share4earth platform communications:

   1. Communications sent from or through us, including email, WhatsApp, and text messages, are intended to enhance your share4earth platform experience.

   2. By becoming a Participant, you agree to receive communications initiated by us, including usage-related information, new services, and promotional offers.

   3. Share4earth platform reserves the right to cancel notification services at any time. If you prefer not to receive such communications, you may not use the Services.

10. Your Information:

    1. Your Information includes all data you provide to the share4earth platform, such as identity information, location data, and communication with other users. This information is stored on our servers for platform use.

    2. You consent to us using Your Information to create a User account and for platform services.

    3. You are responsible for the accuracy and completeness of Your Information. We may rely on it and have the right to terminate the Agreement if found inaccurate or incomplete.

    4. Your Information may be analyzed for usage statistics and promotional purposes by share4earth platform.

11. Information Control:

    1. Location data provided by the share4earth platform is for basic purposes only and may not always be accurate or reliable.

    2. Your Information, including geolocational data, may be accessible to certain users of the share4earth platform.

    3. We cannot verify the accuracy of information provided by users or confirm their identity. You agree to use caution and common sense when using the platform.

12. Privacy:

    1. Use of Services is subject to the Privacy Policy, which may be amended by share4earth platform.

    2. We prioritize user privacy and protect Your Information with physical and technological security measures.

    3. If you object to the transfer or use of your information, please refrain from using share4earth platform Services.

13. Proprietary Rights:

    1. Share4earth platform owns and retains ownership of the share4earth platform, including its interface, logo, trademark, data, websites, content, and source codes. Contingent upon user compliance with this agreement, share4earth platform grants the user a limited license to use the platform.

    2. User grants share4earth platform and other Participants a non-exclusive, worldwide, perpetual license to use user information and content posted on the platform.

14. Intellectual Property:

    1. All intellectual property rights in the share4earth platform and Services are owned by share4earth, including database rights, copyrights, trademarks, user-generated content, and suggestions.

    2. Any submissions provided by users to share4earth platform become the sole property of share4earth platform, which may be them for any purpose without acknowledgment or compensation.

15. Online Content Disclaimer:

    1. Opinions, advice, statements, or other content made available through the share4earth platform are the responsibility of respective authors and it is the responsibility of the reader to use their discretion while reading it or acting upon it.

    2. Share4earth does not guarantee the accuracy or usefulness of any information on the services and is not responsible for any loss or damage resulting from reliance on such information.

    3. Share4earth reserves the right to monitor and remove materials posted on the services that violate the law or this agreement or are offensive or illegal.

    4. Links to third-party sites or third-party applications, software, or content on the share4earth platform are provided for convenience. share4earth is not responsible for the content or policies of such third-party sites.

16. Confidentiality:

    1. User agrees, not to use or disclose any confidential information relating to share4earth platform’s business, operations, and properties for any purpose other than as contemplated herein. Users shall take reasonable measures to protect the confidentiality of this information to prevent it from falling into the public domain.

    2. User shall not have liability to share4earth platform with regard to any confidential information if it was already in the public domain, known to You without restriction, disclosed with share4earth platform’s approval, or disclosed pursuant to a court order.

17. No Agency:

    1. You and share4earth platform are independent contractors, and no agency, partnership, joint venture, employee-employer, or franchisor-franchisee relationship is intended or created by this Agreement.

18. Limitation of Liability:

    1. We, our subsidiaries, officers, directors, employees, or suppliers shall not be liable to You for any incidental, consequential, or indirect damages arising out of or in connection with share4earth platform, our services, or this Agreement, even if advised of the possibility of such damages.

19. Release:

    1. In the event of a dispute with other users or arising from your use of the share4earth platform, You release share4earth platform and its officers, directors, agents, subsidiaries, joint ventures, and employees from any claims, demands, and damages.

20. Breach:

    1. We may terminate your participation and refuse our services if you breach this agreement, provide false information, cause financial loss or legal liability, engage in fraudulent activity, or receive low feedback ratings from other users.

21. Agreement to Arbitrate all Disputes and Legal Claims:

    1. Legal disputes or claims arising from this agreement shall be submitted to binding arbitration in accordance with Indian law, with disputes resolved by a single arbitrator appointed in Bengaluru, India.

22. Notices and Complaints:

    1. Notices to share4earth platform shall be given by certified mail or email. Notices to users shall be provided through the share4earth platform or via the email address provided during registration.

23. Term and Termination:

    1. This agreement is effective upon use for new users and upon posting dates of subsequent amendments for current users. Users may terminate their participation at any time, and share4earth may terminate user participation for any reason.

24. Disputes between/with Members:

    1. Share4earth platform may provide online dispute resolution services for members, but disputes between members shall be dealt with individually between members only.

    2. Share4earth platform reserves the right to suspend or terminate the account of any Member found to be in breach of this agreement.

25. Arbitration and Dispute Resolution:

    1. Disputes shall be resolved by arbitration in accordance with Indian law, in the state of Jammu & Kashmir.

26. Safety Responsibility:

    1. Users acknowledge their responsibility for their safety during carpooling and/or bikepooling facilitated by the share4earth platform. The platform serves as a social technology enabling sustainable commuting, reducing fuel costs, stress associated with driving, and overall traffic congestion. Users are encouraged to utilize the platform responsibly and safely, with matches made based on routes, allowing Carpool Givers and Takers to select their partners.

27. Restricted Activities:

    1. Users agree to use the Carpooling Services in compliance with all applicable laws and regulations. The platform reserves the right to investigate and terminate participation if misuse or inappropriate behavior is observed, including exploitation of the platform or attempts to manipulate the platform guidelines.

28. Information Disclosure and Privacy:

    1. By accepting the Agreement, users consent to share4earth platform accessing and obtaining information such as driving records, location, references, contacts, account balance, and credit information. Users also agree to undergo background checks and authorize share4earth platform to access relevant records during the agreement period, accepting the terms of the platform's Privacy Policy.

29. Indemnity:

    1. Users agree to indemnify and hold share4earth platform and its affiliates harmless from any losses, costs, liabilities, or expenses arising from their use of the Service, including breaches of the Agreement or violation of any laws or third-party rights.

30. Other Disclaimers:

    1. The platform and its services are provided on an "as is" basis without warranties, including accuracy, reliability, or uninterrupted availability. The platform disclaims liability for user conduct, content, or any damages arising from using the services, including personal or property damage.

31. Payment Terms:

    1. share4earth platform manages guidelines around prevailing rates per km for carpooling and encourages users to adhere to the prevailing rates. Carpool givers and takers have to settle the payment among themselves directly through cash or through UPI.

32. Prohibited Use:

    1. The platform should not be used for financial transfers or money laundering activities, with the platform not liable for declined transactions.
